Applicant’s Request

The application for discharge review was received on 20040422. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.


Decision

A documentary discharge review was conducted in Washington, D.C. on 20041022. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: UNDER OTHER THAN HONORABLE CONDITIONS/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.3.




PART I - APPLICANT’S ISSUES AND DOCUMENTATION

Applicant’s issues, as stated on the application:

1. “My issue is that I had a clear and documented pattern of alcohol abuse, which was addressed and not treated. All three of my NJP’s and Page 11 entries were a result of alcohol abuse. I completed the Alcohol Impact Course successfully after the first NJP. After the second NJP I was sent back to the substance abuse counselor where I was asked if I thought I had a problem with alcohol. I responded no and asked my counselor if he thought I had a problem. He stated yes but would not document such because of my denial to my problem. As you will see from my record, my first four years of service was honorable, but after reenlisting, a dramatic and noticeable change occurred due to binge drinking. This also incited depression, which is documented in my medical records. Since being discharged, I have had great support from my good friends that I’ve made in the Corps and local church group in recovering from my addiction. I love the Marine Corps and am proud to have served with the best men and women in the country. Thank you for your time and consideration.”

020906:  Applicant advised of rights and having elected not to consult with counsel certified under UCMJ Article 27B, elected to waive all rights except the right to obtain copies of the documents used to support the basis for the separation.

020906:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. [The basis for this recommendation is his numerous violations of the UCMJ to include three specifications of unauthorized absence, as supported by his three page 11 entries and his non-judicial punishments on 020409 and 020827.]

020919:  SJA recommends suspending Applicant’s discharge six months.

021017:  Commanding officer recommended discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct. [The respondent was the subject of administrative discharge proceedings in September 2002. The Commanding General suspended an under other than honorable discharge for a period of six months on 23 September 2002. The basis for this recommendation is his driving under the influence (BAC .164% on 12 October 20002 and subsequent non-judicial punishment of 17 October 2002.]

021025:  SJA review determined the case sufficient in law and fact.

021029:  GCMCA [CG MCB HAWAII] directed the Applicant's discharge under other than honorable conditions by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 20021029 under other than honorable conditions for misconduct due to a pattern of misconduct (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1.
When the service of a member of the Marine Corps has been honest and faithful, it is appropriate to characterize that service as honorable. An Under Other Than Honorable Conditions discharge is warranted when significant negative aspects of a member's conduct or performance of duty outweigh the positive aspects of the member's military record. The Applicant’s service was marred by three nonjudicial punishment proceedings for seven violations of Articles 86, 111 and 134 of the UCMJ. The Applicant’s conduct, which forms the primary basis for determining the character of his service, reflects his willful failure to meet the requirements of his contract with the Marine Corps and falls far short of that required for an upgrade of his characterization of service. Relief is not warranted.

The Applicant contends that his problems in the Marine Corps can be attributed to his "alcohol abuse." While he may feel that his abuse of alcohol was the underlying cause of his misconduct, the record clearly reflects his willful misconduct and demonstrated he was unfit for further service. The evidence of record did not show that the Applicant was either not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. Representation at a personal appearance hearing is recommended but not required.

A. Paragraph 6210, MISCONDUCT , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16F), effective 01 Sep 2001 until Present.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article 111, drunken driving.
